Laws regulating skilled nursing facilities and assisted living facilities vary by state. However, most states’ regulations address emergency and disaster preparedness, fire safety, staff training, medication management, resident privacy, and background checks. Choose two states and research their statutes and regulations regarding LTC facilities. What do the regulations in these states say about one of these issues? Where do you see the greatest differences in regulations? To what do you attribute this?

Long term care facilities( LTC facilities)

Long term care facilities include assisted living facilities and skilled nursing facilities. It provides medical and also personal care to the individuals who are dependent to others for their daily living. LTC provides both rehabilitative and restorative nursing services to the residents.

Statutes and regulations regarding LTC facilities.

1) California

In California LTC facilities are highly controlled with a robust assortment of laws and guidelines intended to advance occupant autonomy and self course to the best degree conceivable in a residential and non medical setting. Community care licensing division( CCLD) under The California Department of Social Services enforces the statutes through primary licensing process and periodic inspections. Regulations for the Residential care facilities contains 13 chapters that clearly specifices the standards for Licence, application procedures, operating requirements, physical environment and accommodations, staffing, resident records, food service, health related services, and Enforcement.

2) New York

A wast collection of codes, rules and regulations are there in the State of New York regarding the standards for LTC facilities. It says that a LTC should provide the highest practicable physical, mental, and psychosocial wellbeing of each occupant. The law ensure that a LTC should have an administrator who holds a valid licence and a registration issued under article 28 D of Public health Law. Statutes of the State contains standards of Governing body, staffing, nurse aid certification and training, Disaster and Emergency Preparedness, transfer agreements, financial policies, admission policies and practices,misappropriation of resident property and feeding assistant training course.

California; Rules and regulations related to LTC facilities ofCalifornia state is not that specified as comparing to New York. It says" It is recommended that the disaster and mass casuality plan also include utility shut -off locations and the location of first aid supplies. Exit routes and telephone numbers should be posted on all floors.

New York; Rules and regulations related to LTC facilities of New York says" The nursing home shall have a written plan, updated twice a year, with the procedures followed during an internal or external emergency resulting from natural or man made cause. The nursing home shall : 1) train employees in emergency procedures when they begin to work for the facility. 2) periodically, but at least annually review the written plan with existing staff and carry out staff drills in accordance with the written plan at least twice a year".

Greatest difference in comparing both states regulations related to LTC facilities are seen in Patient care services. A range of standards are laid by the State of New York in the areas of patient care that includes the efficient staff by giving them training and even in feeding assistant training course.
