The suspect in a robbery was fleeing from police, when he crossed into oncoming traffic

and collided head on with John Doe’s truck, severely injuring Doe, and killing himself. Mr.

Doe was airlifted to the local hospital burn unit.

Police investigating the robbery and the ensuing accident demanded that hospital

personnel draw blood from the victim, John Doe.

The nurse told police that she was not allowed to draw blood from an unconscious patient.

She further stated that police did not have a warrant and could therefore not collect blood

samples from a badly injured patient. Furthermore, she reiterated that the patient was not

conscious, so he could not give consent.

I would represent the nurse .

1. Communication - The actual problem in this case is that the police needs a blood sample of the injured person. But the hospital can't provide the sample because as per the law enforcement to obtain blood samples from patients suspected of being under the influence, police must either present an electronic warrant, gain patient consent or have the patient under arrest. The police does have an electronic warrant , neither the patient is under arrest nor he has given consent as he is unconscious.

2. Analysis - The solution for this is either the police get a electronic warrant or take him under arrest or wait till he becomes conscious and take sample after getting consent from him .

3. Problem solving - Chosen available solution is having electronic warrant . The person Doe is not a culprit then why should the police have warrant against him . The actual culprit expired at the accident site itself and he was the suspect then why warrant against Doe the suspect flew and crossed the road in hurry to save himself from police and got hit by the truck of Doe .

4. Weakness of the solution - is that as Doe has hit his truck with the suspect and he has expired on the spot . So it will cause a case on Doe .
