Lisa posts a flyer around town that reads, "Reward: $500 for information about the person who keyed my truck last Saturday night in the Ground Round parking lot. Call Lisa at 555-5309."
Wendy calls Lisa the day after the flyers are posted and says, "I promise you that I will find the person that did this to your truck! I am a private investigator and I will drop everything and focus on finding this person. I will not rest until I find out who did this!"
Two days later, Ken, the manager of the Ground Round, calls Lisa and tells her that he saw a man keying her truck and gives her a description of the man and his vehicle.
What type of contract was Lisa seeking to form? Have either Wendy or Ken formed a contract with Lisa? Is anyone entitled to the $500 reward?
Lisa was seeking to form a “Bilateral Contract” with the person who would provide information about the person who keyed her truck on that Saturday night in the Ground Round parking lot. On one hand, culprit is caught through the information provided and on the other hand, reward of $500 handed to the information provider.
No, Wendy did not form any contract with Lisa because he could not able to provide information about the person who keyed her truck. Wendy has only assured Lisa to find out the person who keyed her truck. Ken has provided the description of the man and his vehicle which can be helpful in catching the culprit, so Ken do form a contract with Lisa.
Ken would be entitled for the reward of $500, if culprit could be caught through the information provided by Ken.
