The workers compensation law provides comprehensive and specific benefits to workers who suffer injury or illness during on job time. These benefits include medical expenses, death benefits, lost wages, and vocational rehabilitation.
These are given to the worker as he can not carry out his duties because of his illness or injuries which he has had during his job schedule.
If the employer fails to carry workers' compensation insurance or otherwise meet a state's regulations exposes the employer for not only to paying these benefits out of pocket, but also to paying penalties levied by the states.
Today for every business or organization, who has employees, has to handle the problem of workers' compensation. Most states with a few important exceptions require employers to purchase an insurance policy to handle their statutory obligations to workers who are injured or made ill due to a workplace exposure. Whether your business is small or large, handling the expense and effort of meeting those statutory obligations is an ever present challenge.
There are four major types of workers' compensation benefits available to injured workers.
The first benefit is the medical bills benefits. This is effected as a worker’s compensation pays for 100 % of all reasonable and necessary medical treatment. Many a times, there are often disagreements over reasonable and necessary treatment, especially when doctors and patients disagree on the extent of the injury or course of treatment.
The second benefit is rehabilitation and retraining benefit. This comes into action if you are unable to return to your previous job because your injury prevents you from performing job tasks, here you are eligible for rehabilitation services to overcome your limitations. If those limitations are permanent, you qualify for benefits that pay the costs of retraining to develop skills for comparable employment.
The third benefit is compensation. This benefit is considered when you are unable to work, you receive disability benefits that replace a portion of your lost earnings, usually it is two thirds of your average weekly wages. If you cannot resume your previous position but are cleared for light duty at a lower wage, but there is an additional provision in the clause that if you sustain a permanent loss of function or lose a body part, you can receive additional compensation.
Lastly, it is benefit known as the death benefits. This is effected when a worker suffers a job related death, a surviving spouse and dependent children receive death benefits under workers' comp, which also contributes to funeral and burial costs.
