The duty of confidentially in an employer-employee relationship would be that employees must maintain the confidentiality of the information related to the employer and his business and should not use it for personal benefit without authorization of employer.

The employee must not reveal any confidential information related to the business to any competitor.

The constituent of the confidential information would be any trade secret, any trivial information, or know-how.

Any such information which is sensitive for the business and should not get revealed to any of its competitors should remain confidential.

Any such information which gives a competitive advantage to the company over the others would be a constituent to confidential information.

In any case, the employee breaches the duty of confidentially cost to its employer, and then the employer can put criminal charges against the employee.

The employer can also put termination of the employment contract between the employer and employee. The employee can also make employees pay the civil lawsuit damages for the breach of confidentiality.
