Carrie visited a neighborhood store to purchase some ham, which a salesperson cut by machine in the store. The next day she made a ham sandwich. In eating the sandwich, Carrie bit into a piece of cartilage in the ham. As a result, Carrie lost a tooth, had to undergo root canal treatments, and must now wear a full-coverage crown to replace the tooth. Is the store liable for the damage? Why?

Carrie visited a neighborhood store to purchase some ham, a salesperson cut by machine in the store. The next day she made a ham sandwich. In eating the lunch, Carrie bit into a piece of cartilage in the ham. As a result, Carrie lost a tooth, had to undergo root canal treatments, and must now wear a full-coverage crown to replace the tooth. The salesperson did not add cartilage in the sandwich as it was Carrie’s wish to add that into the ham sandwich. The only person who is liable for this damage is Carrie herself, so she can to even think of blaming the salesperson. If in case she does so, then it would be a kind of significant fraud or something very wrong with the salesperson. As in this case, the salesperson is innocent. Therefore, the store is not at all liable for the damage, and the only person responsible for it is Carrie.
