Litigation basically means requesting court to enforce a particular right or simply it is a lawsuit which is bring in the notice of court to resolve any issues or disputes which are likely to come in front of the court. How it is used in court:? The person who files a particular lawsuit enters into litigation and is often termed as plaintiff. He will demand compensation in any form from the person who has allegedly casued damage to the plaintiff and the person against which lawsuit is filed is termed as defendant. Plaintiff can start this by sending summons or compaint to the defendant. If no settlement is reached after summons then plaintiff can send written question related to the dispute and thus enters into a new process called discovery. Defendant can also start the same process of discovery against the plaintiff. If there is no settlement is reached even after the discovery then a conference is generallly organised by the court which involves both plaintiff and defendant. If no settlement is made in this process then plaintiff can continue with trial court. And then case is filed in the trial court.If a settlement is reached at any stage then litigation is said to be ended. In the trial court, decision taken by the judge of court is final and abiding and has to be accepted by both. It generally results in Compensation by defendant or case ended by plaintiff sided. This case was very important for the safety of the students in COVID situation across the country and can be disastrous also if not discussed and appropriate mesaures not taken.
