Zak offered to sell his Ducati to Mo for 50K dirhams, and Mo agreed but said he also wanted the Zak's helmet with the bike because he liked the design. Individually, the helmet was only worth about 300 dirhams. Zak agreed to include the helmet in the deal. However, when Zak delivered the motorcycle, he refused to give Mo the helmet, saying he changed his mind. Mo paid the agreed price for the motorcycle and helmet.

Do Zak and Mo have a valid contract?

Yes Zak and Mo have the valid contract, because all the conditions for a contract to be valid are met in this arrangement. A contract is said to be valid if it follows below conditions:

  • Acceptance or the agreement : In this case acceptance and agreement both was there
  • Consideration or the Money : 50K Dirhams was the money which was decided by both.
  • Capacity of the party in terms of age and metal ability : In this case this point is also valid.

So above contract would be a valid contract.

No Zack and Mo didn't perform the contract according to its term because Zack didn't give helmet to Mo which was also part of the contract terms.

Zak was violating the term of the contract by not giving Mo the helmet after terms of the agreement was fixed that helpmet is also the part of the deal. In this case Mo can go to court against Zack and file charges against him in breach of contract legal presedence.
