Answer #1

Issues related to the protection of patient privacy are as follows:

· Legislative issue: HIPAA, Consumer Bill of Rights, and HITECH Act are trying to ensure protection to patients' privacy. The consumer bill of rights excludes the right to protect the private information of patients. Moreover, HIPAA does not have the power to provide intended protection to patients' information. The privacy of patients is not adequately ensured by existing healthcare legislation.

· Lack of trust: Patients' trust is significant in protecting the privacy rights of patients. Patients cannot trust the healthcare organization. Lack of trust results in bad patients outcome. Patients do not intend to convey their persona information that creates privacy issues because care staffs confuse between which information to protect and which one to use in the future.

· Lack of patient control: Lack of patient control is a crucial issue for patient protection. Healthcare staffs often fail to maintain control of the patient care data and stores it in some unsecured place that can be easily leaked. The inability to protect patient care data creates privacy issues.
