Focus question

Title VII of the Civil Rights Act 1969 mentions a group of people as protected class and has emphasized against discrimination against these people. The amendment prohibits employment discrimination against people on the basis of gender, nationality, cultural background, religion, race and age. However, the Title VII does not prohibit discrimination against people with different sexual orientation (LGBTQ). Is it fair to leave out the sexual orientation from the protected category? Should this category be included through amendment?

Discussion

One of the key reason why there is a protected class is to remove prejudice during the process of hiring and promotions. Most of these prejudices are due to visible or external attributes on a person. For example gender, race and age differences are visible. On the other hand, differences such as nationality, cultural background and religion are easily exposed. Due to this these attributes are readily included in the protected class.

On the other hand sexual orientation is not something that is easily identified using visual cues in most cases. As a result of this, there may not be any immediate prejudice or discrimination. Moreover, during the formation of the Civil Rights Act, the knowledge about different sexual orientation was not exactly mainstream. Due to this, the lawmakers most likely did not consider it to be a major issue and did not include it in the protected category.

However, given the recent times and the awareness surrounding sexual orientation, we should consider this attribute to be added to the protected category in Civil Rights Act through a new amendment. In the current workplace scenario the LGBTQ communities are most vulnerable to discrimination and we need to create a system where we can provide sense of safety and inclusivity for everyone. This modification should completely address the current requirement.

Amendments are meant to make the constitution and law to be suitable for the current times and this is one such amendment that is needed.
