Disability
This is where an employee may ask to wear sneakers instead of dress shoes due to a foot condition that is a result of diabetes. Or an employee may ask to wear a different uniform shirt because of a severe allergic reaction to the material of the standard uniform shirt.
Gender disparities
A dress and grooming policy that has different requirements for men and women may be challenged since the requirements for one sex are grounded on stereotypes. For instance, if dress code requirements are more extensive for women; mandates for certain hairstyles, stockings, fingernails, and cosmetics will make women to potentially claim that they are being treated differently from their male counterparts
Religious expression
Employers must be prepared to make exceptions to dress codes when an employee has a sincerely held religious belief that conflict with the dress code rules. Religious grooming practices may relate to shaving or hair length and that religious dress may include specific clothes, head or face coverings, and jewelry.
Tattoos and body piercings: Some specific issues
This is a common issue that many employers face in today's modern culture, whether to let tattoos and body piercings. Under the law, employees have no legal right to show body art in the workplace because it isn't considered a religious or racial expression.
