The Americans with Disabilities Act (ADA) came into force in 1990 and safeguards Americans with disabilities. It is considered a civil rights law that ensures disabled people are not discriminated against in jobs, schools, and communities throughout the country.

A physical or mental impairment that significantly restricts one or more of the main life activities of a person even when using preventive activities such as glasses, pills, or hearing aid.

Some employer defenses against claims of violating the ADA are:

  • You had a valid reason for your conduct, and that is non-discriminatory.
  • There is no fair accommodation for the disability of the individual, that is, making accommodation will cause needless hardship for you.
  • The employee presented a clear threat that justified any action you have taken with respect to their employment status.
