Minneapolis a quantity of paving blocks, with delivery to be made in the first six
months of the next calendar year. The contract did not contain any clause excusing a
late delivery in the event of a strike, shortage or similar events beyond the
company’s control. Because of a nationwide boxcar shortage, the company
informed the city that it would not be able to deliver in time. The city protests and
