All three hearing bodies, Federal District Court, U.S. Court of appeals for second circuit and U.S. supreme Court can reach the same conclusion or consensus, it they found that case is guilty in all aspects and there is no illegal decisions made in the hearing process.

But they differ, if the two of the lower courts differ on the views or the evidence provided at different stage for them.
