Each time a state legislature enacts a law that applies the assumption of risk doctrine to a particular sport, participants in that sport suffer. Fully explain your position and what this statement means to you.
Assumption of risk refers to an affirmative defense in the civil lawsuit in which the defense claims that the plaintiff knowingly exposed to the danger or injury. This doctrine prohibits the injured party (victim) to recover and claim compensation for an injury when the person intentionally exposed to the danger after knowing the aftereffects.
In sports, the assumption of the law defines that the plaintiff who has suffered from injuries has prior knowledge of the possibility of risk associated with the sport and thus voluntarily participated, in such case the person does not qualify to get any kind of compensatory measures.
I agree with the given statement. Most of the sportspersons are misusing this doctrine in sports. Intentionally harming the other players while playing and highlight the injury under the assumption of risk doctrine must not be entertained.
The answer is complete, accurate and best in my knowledge and if you find this answer helpful, Kindly give a thumbs-up for more encouragement.
Thank you!
