One of the common workplace torts is misrepresentation. It is one of the common torts where both employer and employee indulge in hiring and selection process. Employee retort this to gain favor in selection and promotion where as employer indulge this to attract best talent from the industry. To deal with this the organization should put in place a proper policy which can balance the rights between employer and employee. The employer should make a detailed background check on the credential provided by the employee during selection and prior to appointment process. It should include past experience and employment, educational, professional conduct, criminal cases of the employee where as employer should provide everything in written to the employee so that they can stake claim if employer fails to provide those things to the employees. It is a kind of win-win situation for both employer and employee where level playing field has been created for them
