Civil liability is when a defendant is held responsible for some wrongdoing or injury to the plaintiff and for that reason the court order the defendant to pay some compensation to the plaintiff such as providing money to redress the damage or injury. It is much different from criminal liability.
Plaintiffs have the allowance to sue the police for different kinds of things but when the damages are done intentionally. There are many laws that protect police officers. They can't be held responsible for the violation of civil laws if they do their duty very well. Some civil liability sources of police departments such as assault, false imprisonment, malicious prosecution, battery, trespassing, or failure to keep the property safe in the department, etc. Civil liability against police officers is very common in state courts.
The primary federal statute that is used in such lawsuits is Title 42 Section 1983. This federal law aims to allow the plaintiffs to lawsuits against the police for any kind of civil liability and civil rights violation.
