When it comes to privacy then an employee has very few privacy rights than a citizen has.But they have many rights at workplace by which the company can not perform any type of search of an employee without any legal notice or permission.There are many rules which a company should have in mind before they perform any search. some of them are-
Never perform any search without any solid reason.
If you want to perform searches then make some policies that is inform the employees about some places those are not personal for example desks or tables.
Never search the body of an employee.
First you need to verify like through cameras and then search.
Lockers and restrooms are not considered in searches without any legal permission.
In case of any stolen property of company the court give the direction to perform the kind of action .If the suspect has some history record of such type of offence or if some employee feel some kind of doubts on the suspect then court will give the permission to the authority for search.
And if the suspect is not having any history or no one has any proof against the suspect then court will take care of the privacy of the suspect .
