The house in which X resided was located on a busy street. From time to time, vandals had broken into his garage and stolen tools and equipment he had stored there. One evening, just at dusk, he saw someone enter his garage. He quickly rushed out to the garage, closed the door, locked it, then called the police. When the police arrived, X discovered that he had locked the municipal building inspector in the garage. Discuss the legal position of X and the building inspector.

It Is normal if sometimes enters your house without your permission you will assume him as thief . Here X was totally in belief that the person eneterd in his was thief due to his past experiences as it is mentioned that from time to time vandals had broken into his garage and stolens tools and equipment. While if we talk about building inspector he has the legal right to enter into the property and inspect it , when needed , as per the law . He dosen't require any permission of the owner of the property which ultimately gave X the impression that building inspector was a theif. Though X had an honest belief about the thief but may be it was an excuse. Failure of X to determine excatly identity and the reason for which inspector entered the which was legal , however this will Make X Liable for the tort.
