Brett Berry visited a Bayview in Savannah, Georgia. He took the receipt after ordering his cappuccino and croissant. While walking to a table, he noticed that someone had drawn a donkey on his coffee cup. Before Brett could get to his table, he stepped in some water, slipped, and fell, sustaining injuries to his back and left leg. Brett filed a lawsuit in a Georgia state court against Bayview, the store manager, and the employee who made his coffee. The headquaters of the corporation is St. Petersburg, Florida.

As, here Brett Berry visited a Bayview in Savannah, Georgia, and he took the receipt after ordering his cappuccino and croissant. While walking to a table, he noticed that someone had drawn a donkey on his coffee cup. However, there is no indication that water on the floor caused due to that donkey, again, before Brett could get to his table, he stepped in some water, slipped, and fell, sustained injuries to his back and left leg. So, here claim like Personal Injury, Negligence claims and Incidental Torts can be done by Brett in his Lawsuit, any slip and fall cases usually fall within Incidental Torts case,

As, here Brett stepped in some water, slipped, and fell, sustained injuries to his back and left leg. So Brett can provide his arguments that the Bayview, and its manager, Employee has ownership for this particular duty of care to their guests, visitors, but they failed to meet that level of care, again, due to such negligence and poor care, Brett sustained injuries to his back and left leg, and such event created tangible harm on Brett, thus, he can claim against, Bayview and put forward the irresponsible nature, as their duty to examine the entire area to maintain safety and further he can claim negligence of the Manager and Employee, Brett can claim for the money compensation for his Injury,

Arguments for the Bayview, Manager, and the employee, at the register could be like Brett should look at the water on floor, before keeping his leg on this water, and Brett should keep putting Observation around to save from any accidental case,

   

   However, here Brett will have higher probability to win and he can sue the Bayview, Manager, and the employee at the local court of Georgia, where Bayview has its own premises, however, Bayview may have headquarter at St. Petersburg, Florida. But because, Bayview has its own establishment at Georgia and the event of Injury occurred within the establishment, thus, Brett can sue them at Georgia, the Bayview and their Employee can transfer this risk to Insurance Authority based on the policy undertaken by them which, can help them to escape from any big financial and organizational loss,
