Globe Life Insurance Company undertook a new sales program that targeted neighborhoods in Los Angeles where drive-by shootings had been a nightly occurrence. In two such shootings, children were killed as they sat in their living rooms. Globe salespeople were instructed to “hit” the houses surrounding those where children were victims. They were also told to contact parents of the victims to sell policies covering their other children. Globe salesman Tom Raskin read of a shooting at Nancy Leonard’s house in which Ms. Leonard’s five-year-old son was killed. The newspaper said that Ms. Leonard was a single parent and had four other children. Raskin went to Ms. Leonard’s house and sold her a $10,000 term life policies for each of the children for a total cost of $21 per month. Ms. Leonard was in the course of making funeral arrangements for her son and Raskin noted, “See how much it costs for a fumeral.” Ms. Leonard had been given several tranquilizers the night before by a physician at the hospital’s emergency room which she had taken one an hour before Raskin’s visit, washing it down with a can of beer. Ms. Leonard signed the contract for the policy. After her son’s funeral, she received Globe’s first month’s bill for $21 and said, “I didn’t buy any life insurance. Where did this come from?” Is the life insurance contract enforceable against Ms. Leonard?

After going through the case, it seems that life insurance contract cannot be enforceable against Ms. Leonard as any contract which is made when person entering into contract is not in senses than that contract become non enforceable. We should note here that person who are intoxicated cannot legally enter into a contract and intoxication thereby makes the contract voidable, however this needs to be proven in the court of law.
