ANSWER-

A dying declaration is permissible if the promoter of the statement under the federal rules of evidence.

  • Some state gives permission of dying declaration in some other case. The announcer's statement is being provided in a delinguent pursuit for killing.
  • The statement of the announcer has done under actual faith when it is certain that his death was near. It does not mean that he has to die in real.
  • The announcer's statement relates link to the reason of what an individual trust to be his near death.
  • Some other common rules of permissible also petition, as the need that the statement should be construct on the announcer's real knowledge.
  • The statement should be related to the situation or the reason of the announcer's own close death.
  • If there was no physical evidence of a offence, in that case dying declaration will not permissible as evidence.

A dying declaration means a verbal or written statement made by an individual who is dead.
