SWD is a company that produces medical products. During the winter they advertised in the newspapers offering a reward to anyone that got sick with flu after using their products. Susan, a student at NUST saw the advertisement. She falls sick of flu after using their products and they have refused to give her the reward. Advise Susan.
Considering all the implications and statements true on the behalf of Susan that she has fallen sick even after the usage of the company's product has remedies available us under the contract act:
1. Sue for Damages: Aa the advertisement got published in the newspaper and they claim about the same of awarding the people who have got ill even after using their products, Susan is entitled to breach the contract and sue the company for the damages either monetary or non monetary as terms have been violated.
2. Sue for Specific Performance: As it is a medical condition, Susan can also ask the company for the specific performance by delivering a more effective medicine to her to cure her disease.
3. Monetary Compensation: At last, if nothing happens, she can sue the company in the court for the monetary compensation for the charges and rewards both which the company is liable to pay to her because of the advertisement in the newspaper.
