1) Ezekiel takes his dog for a walk. While on the walk, he decides to take his dog off the leash as there are no people around. Suddenly, out of nowhere, a small child carrying a porterhouse steak appears, and unable to control himself the dog lunges for the steak and accidentally bites the child on the hand. The injury is relatively minor and does not even break the skin. (The dog does get, and eat the steak.)
If the child’s parents sue Ezekiel for negligence what is the likely outcome and why?
Ans. The child's parents may win the case because of the following reasons :
Ezekiel took the dog's leash off , which leads to negligence and would go against him.
Child's parents can charge them for damages , including that of the injury and the emotional trauma caused.
Ezekiel wasn't able to take reasonable care and precautions while walking the dog . This would also go against him.
The child didn't provoke the dog and it wasn't a private property. Hence it goes on the favor of Child.
