Supreme court in this case held that forced extraction was improper and reversed the lower's court decision.
In Mapp v. Ohio case, on account of information that a suspect was hiding in Mapp's home, Police forcibly entered into her house and when she demanded a search warrant from police, they produce a paper alleged to be warrant. As a result of the search, books and photos belonging to Mapp was produced as evidence. She was convicted of keeping obscene things despite the fact that no proper arrest warrant was issued for the search. Supreme court in this reversed and remanded back to the trial court.
I agree with the Supreme court decision in both the cases as this has been done according to the law and if done is violation of the right of its citizens. In the first case, police should seek permission for the same as well as in second case, proper arrest warrant should be issued for search.
