*Note the business name is "Sprinkles" Macey Anderson’s cupcake business, Sprinkles, is booming. She needs a new commercial kitchen to produce the cupcakes she sells. She’s found a building that has all the necessary wiring and structure, and it’s a steal! Instead of leasing, she decides to jump in and buy the building for her business because it’s priced about half as high as similar buildings in the area. Yesterday a customer came into Sprinkles and fell when she stepped through a rotted floorboard. Now she says she’s going to sue Sprinkles for all her medical bills and damages. Macey’s lawyer says the customer may have a solid case against Sprinkles, but Macey thinks she has nothing to worry about because she did not know the floorboard was rotted. Is Macey correct or is her lawyer correct? Please explain.
As the business is Macey's ,no matter if the building is her own or leased, it is her responsibility to ensure the place is safe and clean. She cannot escape saying she does not know about the floorboard because as the owner of the shop she need to check everything and anything would be her responsibility . Hence her lawyer is correct in this situation and Macey needs to pay for the medical bills of the customer.
