Answer: A company might not decide to not file a patent when it is easy for a competitor to replicate the product. If the technology is not very unique and would be copied soon in a while it does not make sense for the company to file for a patent. However, they should focus on making their product much more superior and better so that they can capture a wider market share.

The positives of the following are as follows:

1. It keeps the company under the pressure of continuously innovating

2. It creates an image in the market that the company is not rigid to its technology

3. It helps in the development of the industry as a whole.

The negatives of the following are as follows:

1. It requires continuous expenditure on research and development

2. The benefit of technology generated by the company would be shared by all.
