Babinski prepared and duly executed a living will in which he gave explicit instructions not to be resuscitated in the event he became incapacitated or permanently unconscious without hope of recovery. Twelve years later, Babinski had a change of heart and decided that he wished to receive all appropriate treatment in such circumstances. Is Babinski’s living will an example of an advance directive? Is Babinski’s living will an example of a durable power of attorney for health care? Can Babinski change his living will? Would Babinski’s living will have expired on its own by the time the 12 years had elapsed?.

answer-

Yes, Babinski’s living will an example of an advance directive because in his will he specify what treatment should be or should not be given when he is unable to make decision on his own or become permanently unconscious without hope of recovery.

No, because A durable power of attorney for health care, also known as a medical power of attorney, is a legal document in which you name a person to be a proxy (agent) to make all your health care decisions if you become unable to do so. in his will there is no name of agent or person who will make decision for him.

Yes, Babinski change his living will as long as he is able to make his decision or competent because If the man is awake and alert when he’s brought into the hospital, he can accept any kind of treatment he wants, regardless of what’s in his living will.

No, living will generally do not expire while you are alive, and after 12 years he was alive.
