Compare any three of the following: final-offer interest arbitration, double final-offer interest arbitration, night baseball arbitration, med-arb, arb-med. Which is "the best" (and what do you mean by the best)? Why?

  • Night baseball arbitration gives both of the parties a last chance to submit the best proposal from their side of the story, after the arbitration and the arbitrator chooses one of the two proposals without adjustment. Therefore, it gives a last fair chance to both of the parties to submit the best possible offer to help influence the arbitrator’s decision.
  • MedArb has qualities of both mediation and arbitration. The first chance of mediation between the two parties if given, if the compromise does not happen, the arbitration is done and the arbitrator’s award is binding.
  • ArbMed is the opposite of med-arb, which first the arbitration is done and the parties can choose to mediate as close as possible.

“The best” process to me would be the MedArb method, because it involves features from both mediation and arbitration. What I mean by “the best” is what would be the most logical choice to me personally.
