Answer- ADR is the method that are used to settle down any conflict between two parties out of the court and this is seen as one of the best methods to resolve the situation as it is quick, fast and time-saving than the lawsuits.
I can quote my own example in order to explain how I used ADR. In my pat organization, I was working with a software company as a marketing manager and the company has a non-competitive clause in its employment contract that indicates that once I leave the job, I cannot start my own venture for 2 years in any industry related to IT and software development within the periphery of 200 miles of the head office of the organization. When I was working there, I gained a lot of knowledge and had good customer contacts. I decided that this was the time to start my own venture and thus I resigned from the post and made a small software development company in a city that was 250 km from the head office of my ex-employer.
I business was doing good but one day I got legal notice form my ex-employer quoting that I breached the non-competition clause which I signed in my employment contract. In fact, this was not right as I started my business at a distance of 250 km. I approached the private consultancy which provides help in this sort of case. They started mediation between the ex-employer and me. After a lot of discussions and clarifying the different facts and figures, the conclusion of the case was that I can operate from my current location but I cannot contact any of the clients of the ex-employer. This was mutually agreed by both of us. This is how mediation worked in my case.
