This act was a response to counterfeit Native American art that was being produced in the US, Japan, Taiwan, Korea, and India. The act makes it illegal for anyone who is not officially enrolled in a band, tribe, or confederated group to claim their Indian status in marketing the art. However, this has made it illegal for American Indians who are not enrolled for any number of reasons, but otherwise Native, to identify themselves as related to their group without great risk. While many see this act as a great safeguard, it has tragically stripped many American Indians not only of their livelihood, but also their ability to claim their own ethnic identity.
