BFOQ stands for ‘Bona fide occupational qualification’ are qualifications offered by the employer which is being considered to for decision making related to the hiring and employees retention. It is related to the important job duty and is considered important for the specific business operation. For example, maximum age limit for the airline pilots due to safety clauses. Whereas, FMLA stands for ‘the family and medical leave act’ ensures certain employees to have up to twelve workweeks of unpaid leave every year with fear of unemployment. It is applicable for employers who can offer employees unpaid leaves for “qualified” medical and family reasons under specific circumstances.
