What theory might subject an employer to liability for an employee having an automobile accident due to going to sleep driving from work to home after work?

The employer has the duty of care towards it employee and under all circumstances and situation shall take care of the mental health, work pressure, illness etc. of the employee so that employees are healthy and can remain fit to work.

In the stated case the employer can be held liable for negligence to not asses the physical and mental situation of the employee and there could be other reasons as the employee would have overworked, or had given so much of pressure and tough task which would have made him tired and he was sleepy while on his way after work and therefore got into accident. A tort action can also be brought against the employer demanding compensation for the same.
