Since the divorce decree was not signed till January 2018, Alicia will be considered married and she can file the returns either jointly or separately.

Since the divorce decree was not signed, either parent can claim Richard as dependent. If there is a joint return, there would be no issue however if they file separately,either parent can claim him as dependent.
