The difference between negligence and liability can be described in the following way. The business owners are held responsible if they fail to carry out the duty and the failure itself resulted in an injury. Whereas, strict liability cases arise against the sellers and the manufacturers that either sell or manufacture defective products, and injuries arise from such defects.

In my opinion, there are situations where product liability standards can be used and it arises from the different issues in improper manufacture and sale of products.

There are situations under which strict liability standard can be implemented and it includes, for example, the plaintiff to highlight that product to be unreasonably dangerous and unsafe when it was sold, manufactured or designed. The plaintiff is injured from the usage of the defective product.
