In my opinion, the situations were mishandled here. Emancipated minor is a person under the age of majority who is completely self supporting and able to contract. Emancipated minors can give effective consent for the administration of medical treatment and medical practitioners will not be held liable for treatment without the consent of parent or guardian. In this case the minor is living away from the parents and made her own financial decisions and managed her own affairs. This means that she is self supporting. But she is provided with income for private schooling and certain medical care by her parents. An emancipated minor should be self sufficient and parents are not supposed to support an emancipated minor in any way including medical care or school fee. It will affect the emancipation status and contractual ability. There is a possibility of legal recourse against the parents in case of contract breach by the minor and the medical practitioners also will be held liable for treatment without the consent of parents.
