TORT LAW IN PROMOTING QUALITY HEALTH CARE

Tort reform is legislature usually passed at the state level which affects the malpractice law of a state. Tort reform usually includes laws that limit, or cap, the amount of money that patients can receive as an award from a clinician they've sued for malpractice. Additionally, tort reform caps the amount of punitive damages a judge can order the physician to pay. In some states, tort reform also puts tighter restrictions on medical malpractice suits to be tried in court, as opposed to dismissed or dropped.

ROLE

The law can address disputes over unsafe injection practices in a variety of ways. Administrative agencies may hold a provider or facility responsible for preventable harms according to specific statutory and regulatory provisions governing licensure. State courts can compensate victims of certain actions or inactions based on tort law, where a breach of a legal duty caused damages.

The law can be deterrent and therbyt a tool for prevention, providing options to prosecutors and the public under existing legal sources.

Law enables public and private institutions to promote public health and safety objectives. Statutes that empower state health agencies to establish regulatory provisions may concurrently enable healthcare entities to support disease prevention

Law also delegate authorities and responsibilities to individuals to support public health and safety goals. Sate public health regulations seek to improve access to health care by establishing, for example, a broad scope of practice for rural providers who meet enhanced training requirements.

DETOR ERROR

A system error is an occasional, simple human error. Deterrents cannot reduce these errors, because they are made unintentionally. From time, humans unwittingly make errors, such as mistaking salt for sugar when baking, mistaking an oxygen tank for nitrogen tank during airplane maintenance. This is not a decisional error, and so is not negligence. It is considered a system error because good organizations recognize the human error component and safeguard against it.

ALTERNATIVE OF TORT LAW

No- fault auto insurance is the most common form of TORT LAW alternative. In a no-fault insurance arrangement, the injured party is actually limited in their ability to file a lawsuit against the party that caused the accident. The victim will not be allowed to seek compensation in court, except in very serious cases. InsreIn, each party's insurance company will pay for any losses associated with the account.

No fault auto insurance and strict liability are the two examples of no- fault recovery.
