The main difference between a murder prosecution and a wrongful death lawsuit involving same parties and same facts is that a murder prosecution is a criminal lawsuit that is instituted by criminal prosecutors and it can therefore lead to incarceration. Wrongful death lawsuit on the other hand is a civil lawsuit that is instituted by survivors or estate citizens against organizations or individuals who are responsible for the death in question. It cannot directly lead to incarceration.
