The 1967 Age Discrimination Act is a U.S. law that prevents certain employees from discrimination in the workplace 40 years of age and older. Actually, the Age Discrimination in Employment Act (ADEA) forbids the use of the age of a worker or job applicant as a consideration of recruitment, transfer, dismissal, payment and terms, conditions and employment rights.
The 1967 Act on Age Discrimination in Employment discussed the widespread trend of using arbitrary age limitations to make hiring decisions. This indicated that the job loss due to long-term unemployment impacts older workers more. The purpose of the legislation was to mitigate such harmful effects. The Act, administered by the Equal Employment Opportunity Commission, applies to private or government companies with at least twenty employees (in the present or previous fiscal year on a regular basis), as well as to labor activities involving members of the union.
The Act provides a stringent age-based ban of discriminatory practices. In general, it prohibits: discrimination in hiring, granting and denying raises, salaries, terminations and layoffs. Use or make statements in regard to certain age requirements and limits. Denying benefits for older staff. Note: The individual is able to limit age-based compensation only if the cost of providing reduced benefits for older workers is the same as the cost of providing full benefits for younger workers. Compulsory withdrawal at some point (mandatory retirement for workers based on age is permitted with executives who are entitled to a pension that pays over an annual minimum sum.)
