YES, Jessica can sue the firm in this case. It is a pure gender discrimination where society value males more than that of female even though they are not worthy enough to get praised. Due to the discrimination, many qualified female employees don't get promotion and instead a less qualified male employee gets that position. Such as in case of Jessica Hopkins, she has also been discriminated and the committee didn't gave the promotion to Jessica as she is a female. So, she has the right to sue the firm for this act according to Title vii civil Rights act of 1964.

On the other hand, NO, I don't agree with the law in the area which prohibits a female to get deserved position and discriminating openly. Jessica's case is a gender discrimination, although the committee hiked her salary to satisfy her, but they purely discriminated her on some vague perception. The committee felt that the clients may not respond well if they see a female employee marketing manager. There are many laws to protect employees from discrimination but still this area discriminate employees on the basis of gender for their business gain.
